1. The service
Tipoff, operated by Matthew Stone, creates and manages Facebook lead ads in an ad account you own, delivers leads to you by text message, and provides related reports and tools.
2. Your accounts and your money
- You must connect a Facebook Page and ad account that you own or are authorized to use.
- Ad spend is paid by you directly to Meta using the payment method on your ad account. We never hold, receive, or mark up your ad spend, and our fee is never a percentage of it.
- You are responsible for your ad account's standing with Meta and for complying with Meta's advertising policies.
3. Approvals and automated changes
No new campaign launches without your approval. Once live, you authorize us to make limited adjustments within the guardrails shown in your Settings (for example, capped daily budget moves or pausing an underperforming ad). Changes above those limits are sent to you for approval first. You can pause any campaign at any time.
4. Fees and billing
- The subscription is $149 USD/month, billed in advance through Stripe. This is our fee only; your advertising budget is paid by you directly to Meta from your own ad account.
- Subscriptions renew monthly until canceled. Cancel any time from the Billing page; you keep access until the end of the paid period.
- Fees already paid are non-refundable except where required by law.
- We'll give at least 30 days' notice before changing prices.
5. No guaranteed results and no warranties
Advertising results depend on many things outside our control, including Meta's systems, your market, your offer, and how quickly you follow up. We do not guarantee any number of leads, calls, jobs, or return on ad spend.
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties or conditions of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that leads will be genuine, accurate, or convert into jobs.
6. Your content and data
You own your business information, ads, and leads. You grant us permission to use them only to provide the service. You confirm your business information is accurate and that your ads and offers are lawful. Our privacy policy explains how we handle data.
7. Leads and communications
Leads are people who asked to be contacted about your services. You are responsible for how you contact them, including compliance with telemarketing, texting, and privacy laws that apply to you. See our SMS terms.
8. Acceptable use
Don't use the service for unlawful, deceptive, or discriminatory advertising, to target restricted categories in ways Meta prohibits, or to interfere with the service. We may suspend accounts that do.
9. Third-party services
The service depends on Meta, Twilio, Stripe and other providers. Their outages, policy changes, or account decisions may affect the service, and we're not responsible for them.
10. Limitation of liability
To the fullest extent permitted by law, Matthew Stone is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost jobs, lost revenue, lost data, or ad spend charged by Meta, even if advised of the possibility. Our total liability for all claims in any 12-month period will not exceed the fees you actually paid us in the three months before the event giving rise to the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless Matthew Stone from any claims, damages, losses, and costs (including reasonable legal fees) arising out of your business, your ads and offers, your use of leads or how you contact them, or your breach of these terms or of any law that applies to you.
12. Termination
You can cancel any time. We may terminate or suspend the service for breach of these terms or non-payment. On termination we'll disconnect from your ad account; your ads, Page, and ad account remain yours.
13. Governing law
These terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there. Nothing in these terms removes any consumer rights you have that cannot be waived under the law that applies to you.
